This Agreement includes a disclaimer of liability in Section 7. Please review that section (and all other terms) carefully. This CLIENT AGREEMENT (this “Agreement”) is a legal agreement between NICE HEALTHCARE LLC. ("nice healthcare", “nice,” “us,” or “we”) and you individually (in each case “you” or “your”).
If you wish to participate as a client of nice, you must click on the “I accept the terms and conditions of this Agreement” button. By clicking the “I accept the terms and conditions of this Agreement” button you acknowledge: (a) that you have read and understood this Agreement; and (b) that this Agreement has the same force and effect as an agreement signed with original signatures. If you do not click on the “I accept the terms and conditions of this Agreement” button you will not be entitled to participate as a client of Nice.
This Client Agreement was last revised in January 2019. We reserve the right to change the terms contained herein, in our sole discretion, at any time. BY CONTINUING TO USE THIS SITE OR ANY ASSOCIATED APPLICATIONS AFTER SUCH CHANGES ARE POSTED, YOU AGREE TO BE BOUND BY THE MOST RECENT VERSION OF THIS CLIENT AGREEMENT. You are expected to check this page each time you access this Site so you are aware of any changes, as they are binding on you. This applies whether we give you notice of the changes or not. You warrant that you have full authority to accept and perform this Agreement.
The deposit is non refundable. All fees are paid monthly or annually via the Nice Healthcare billing portal. Members that cancel their membership before their first visit will receive a full refund. Members that cancel their membership after their first visit will not be eligible to receive a refund. If a monthly payment is missed the membership will be canceled and a new deposit and membership will be required to resume service. FAMILY MEMBERSHIPS: The family memberships for multiple people are for individuals living at the same street address. For more than 5 people, additional fees apply. If the persons on the membership are changed, the signup fee will be assessed for each person changed each time they are changed. If fewer than 5 people are placed on the membership at time of signup, additional people up to 5 people may be added at no additional charge.
2) Scope of Services
Nice Healthcare members receive primary care services. At our own discretion we will send a medical provider to Members’ homes on file in our systems in accordance with their membership level after a chat or video visit. The services included in all membership levels are as follows: 1) chat visits, 2) online video visits, 3) in home visits, 4) select labs, 5) wellness, chronic condition, and pregnancy coaching, 6) select prescriptions with 7) home delivery of said prescriptions
MN Nice memberships include 1) weekend visits (defined as Saturday and Sunday) and 2) evening visits (defined as after 5 pm)
Nurse practitioners will also prescribe medications and make referrals to specialists and hospitals as required based on their medical judgement.
Nice Healthcare's hours of operation are: for virtual visits: 8 am - 7 pm central standard time Monday to Friday and 9 am - 12 pm central standard time Saturday to Sunday. For home visits the hours are the same except for Monday to Friday the hours are 9 am to 5 pm. These hours can and may be changed in the future.
We are closed the day before, the day after, and the day of 10 major holidays and services are not available on these days.
If you lose your prescription/medication that was delivered to you from Nice, a new supply will not be delivered until it would have been regularly scheduled. If it was a one-time (acute) medication it will not be delivered again. Our providers can discuss with you the option to send the medication to a pharmacy of your choice. You would be responsible to pick up your medication and any co-pay or other costs of the medication.
3) Uncovered Services
The membership does not include speciality labs, non covered prescription drugs, imaging, speciality imaging, or speciality care normally provided by a specialist. The membership does not include urgent care or emergency care services. If you need immediate assistance you should dial 911. Nice Healthcare does not prescribe controlled substances on the DEA list. Nice Healthcare does not provide the genital or breast portion of women or male physicals.
4) Availability of Visits
There is no limit to the number of visits you can have once you become a member. We strive to provide same day virtual and home visits but cannot guarantee same day visits. Home visits are available only to certain membership levels.
5) Cancellation Policy
A patient may cancel their appointment with Nice Healthcare a minimum of 24 hours in advance. A cancellation made less than 24 hours before the scheduled appointment will result in a $50 fee. We reserve the right to cancel any membership at anytime for any reason, if we choose to do so, we will refund the equivalent of one month's membership fees. You may cancel your membership at any time, if you do, we will refund the equivalent of one month's membership fees if fees were paid annually.
6) Limitation on Liability
NICE HEALTHCARE’S AGGREGATE LIABILITY SHALL, IN ALL CASES, BE LIMITED TO THE AMOUNT PAID BY YOU TO BE A PARTICIPATING CLIENT OF NICE HEALTHCARE.
